Apparently it would have been too hard to move the shackle to the proper location - a whole 2 inches away. Then of course there's the whole "crossing the chains " thing.

The license plate clearly shows the car to be from "The Garden State." From this we can easily surmise that the hitch will only be used to pull a small trailer containing sustainable / free range / organic gardening supplies. No police officer in their right mind would ticket somebody like that. Besides, what could possibly go wrong?
